Terms of Service
Last updated 12 October 2026
These terms apply to your use of the Built by Berry website and to the services we provide. If we agree a written proposal or agreement with you for a project, that document applies to the project and takes priority over these terms if they conflict.
The website
- The information on this website is general and is not legal, financial or tax advice.
- The calculator gives an estimate based only on the numbers you enter. It is not a promise of savings or results.
- Please do not misuse the website, interfere with it, or copy our content without permission.
The Jumble Scorecard
- The Jumble Scorecard is a free online health check. You answer questions about your business and we show you a score, an estimate of what the jumble is costing you, and suggested quick wins.
- Scores, estimates and savings ranges are a general guide calculated from the answers you give and some stated assumptions. They are not financial, legal or professional advice, a quote or a guarantee of any result.
- You can ask us to email your full report. If you send an enquiry, we call you back on the number you give us. You are not obliged to buy anything from us.
Custom projects
- Project work is scoped in a written proposal that sets out the deliverables, price, timeline and payment terms. We start work once you accept it.
- Changes to the scope are agreed in writing before they are done.
- You agree to give us the access, information and decisions we reasonably need, in good time.
- You own the deliverables we create for you once you have paid for them in full. This does not include our pre-existing tools and methods, or third-party and open-source components, which stay under their own licences.
Confidentiality
We keep your business information confidential and use it only to provide our services to you. We expect you to do the same with our proposals, methods and pricing.
Third-party tools
Software and services you pay for stay in your name and under your control. We are not responsible for third-party outages, price changes or changes to their terms.
Our responsibility
- We provide our services with due care and skill.
- Nothing in these terms excludes or limits any right you have under the Australian Consumer Law that cannot be excluded.
- Subject to that, and as far as the law allows, our total liability for a service is limited to the fees you paid us for that service, and we are not liable for indirect or consequential loss.
Privacy
How we handle personal information is set out in our Privacy Policy.
Governing law and contact
- These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction.
- Questions about these terms: request a call through the enquiry form on this website.
